These Terms of Service (“Terms”) govern your access to and use of the Kit n Kat Shop website and any purchases made through it (the “Site”). By visiting our Site, placing an order, or interacting with our services, you agree to be bound by these Terms.

1. Overview

Kit n Kat Shop (“we,” “us,” “our”) offers made-to-order, handcrafted, and custom products, including items created from customer-submitted photographs and other materials. All purchases are subject to these Terms and our posted policies, including our Return & Refund Policy, Shipping Policy, and Privacy Policy.

2. Eligibility & Account Responsibility

  • You must be at least the age of majority in your jurisdiction to make a purchase.
  • You agree to provide accurate, current, and complete information at checkout, including shipping address and contact details.
  • You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.

3. Product Nature (Made-to-Order & Custom Work)

Most Kit n Kat Shop products are produced on demand and may be hand-finished. As a result:

  • Minor variations in color, texture, finish, and small dimensional differences are normal and are not considered defects.
  • Product photos are provided as close representations but may vary slightly from the final product.
  • Measurements and capacities (where provided) are approximations unless explicitly stated otherwise.

4. Custom Product Submissions (Photos, Text, Artwork)

For custom products (including photo-based creations), you may be required to submit photographs, text, names, or other materials (“Customer Content”). By submitting Customer Content, you agree that:

  • You own the Customer Content or have the legal right and permission to use it.
  • You grant Kit n Kat Shop permission to use Customer Content to produce, modify, and fulfill your order.
  • You understand that artistic interpretation and technical constraints may require adjustments such as cropping, simplification, or reinterpretation to achieve a stable, printable, and display-worthy result.

Kit n Kat Shop is not responsible for issues resulting from Customer Content limitations, including but not limited to:

  • low-resolution, blurry, dark, or obstructed photos
  • incorrect uploads
  • missing angles or incomplete reference images
  • limitations caused by lighting, shadows, reflections, or image compression

By placing a custom order, you acknowledge that the final product may reflect the quality and clarity of the Customer Content provided.

5. Review, Approval & Production Decisions

Some custom orders may require review before production begins. Kit n Kat Shop reserves the right to:

  • request additional photos or clarification
  • decline an order if the Customer Content is insufficient to produce a reasonable result
  • make production decisions required for stability, strength, and quality (including pose adjustments, base supports, and surface finishing choices)

If an order is declined prior to production due to inadequate Customer Content, we may cancel and refund the order in whole or in part at our discretion.

6. Ordering, Pricing & Payment

  • All prices are shown in the currency displayed at checkout and may change without notice.
  • Taxes and shipping charges (if applicable) are calculated at checkout.
  • We reserve the right to correct pricing errors and to cancel orders placed at an incorrect price, even after an order is submitted.
  • By submitting payment, you represent that you are authorized to use the chosen payment method.

7. Cancellations & Changes

Because most items are made to order, cancellations and changes are limited:

  • Orders may only be canceled within 12 hours of purchase, provided production has not begun.
  • Once an order enters production, it cannot be canceled or changed.
  • Address changes may not be possible after shipment. Customers are responsible for ensuring shipping details are correct at checkout.

8. Shipping, Delivery & Risk of Loss

Shipping timelines include both production time and carrier transit time. Once an order has been transferred to the shipping carrier and tracking has been provided:

  • delivery responsibility lies with the carrier
  • risk of loss transfers to the customer

Kit n Kat Shop is not responsible for:

  • carrier delays
  • packages marked delivered by the carrier
  • lost or stolen packages after delivery confirmation
  • incorrect addresses provided at checkout

We will assist with carrier claims when possible, but outcomes are not guaranteed and are subject to carrier policies.

9. Returns, Refunds & Defects

All return and refund matters are governed by our Return & Refund Policy. In general:

  • custom and made-to-order items are final sale
  • we do not accept returns for change of mind
  • verified damage or defects must be reported within the timeframe stated in our policy

10. Chargebacks & Payment Disputes

If you experience an issue with your order, please contact us first so we can help resolve it. If a chargeback or payment dispute is initiated, we may provide documentation to the payment provider, including:

  • order confirmation
  • production records
  • shipment tracking
  • delivery confirmation
  • customer communications

Abuse of disputes, fraudulent claims, or repeated chargebacks may result in refusal of future service.

11. Prohibited Uses

You may not use the Site or our services to:

  • violate any laws or regulations
  • submit infringing, defamatory, abusive, or illegal content
  • attempt to gain unauthorized access to the Site or systems
  • engage in harassment, fraud, or malicious activity

12. Intellectual Property

All Site content, including text, images, branding, product names, and designs, is owned by Kit n Kat Shop or used with permission and is protected by intellectual property laws. You may not reproduce, distribute, or exploit Site content without written permission.

Customer Content remains owned by the customer, but you grant us a limited license to use it solely to fulfill your order and provide customer service.

13. Limitation of Liability

To the maximum extent permitted by law, Kit n Kat Shop shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products purchased, including but not limited to lost profits, lost data, or service interruptions.

Our total liability for any claim related to an order shall not exceed the amount paid for the product(s) at issue.

14. Indemnification

You agree to indemnify and hold harmless Kit n Kat Shop from any claim, demand, or damages arising out of:

  • your breach of these Terms
  • your misuse of the Site
  • your submission of Customer Content that violates third-party rights

15. Service Refusal

We reserve the right to refuse service, cancel orders, or limit purchases at our discretion, including in cases of suspected fraud, abuse, harassment, or policy violations.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page and are effective upon posting. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
